IMPORTANT NOTICE:




This document is governed by West Virginia law, including the West Virginia Consumer Credit and Protection Act (W. Va. Code §46A-1 et seq.


It addresses your rights to a written estimate, authorization requirements, return parts, and other protections. 


Read carefully before signing. By signing or authorizing repairs, you agree to these terms. 


  1. Scope of Services and Repair Order We agree to perform the repairs, maintenance, diagnostics, or services described in the attached or separate Repair Order/Work Order/Estimate ("Work Order").

    The Work Order is incorporated by reference. Additional or changed work requires your prior authorization.


We perform work with reasonable care consistent with industry standards. Parts may be new, OEM, remanufactured, aftermarket, or rebuilt (disclosed on the invoice). For crash/collision repairs, we comply with W. Va. Code §46A-6B regarding crash parts disclosures.


2. Written Estimates and Authorization 

  • Written Estimate Requirement: Before beginning work, we will provide you a written estimate including the estimated price (parts and labor), estimated completion date, and description of work. This complies with West Virginia requirements. 
  • You may waive the written estimate in writing. If waived, we will provide an oral estimate and document the waiver and oral estimate in our records.
  • Authorization: You must authorize the repairs (written or oral, as documented). We will not perform unauthorized repairs.
  • Cost Overruns: We will not charge more than the written estimate without your approval; except we may charge up to the lesser of 20% of the estimate or $50 without further approval. If costs exceed this, we will stop work, notify you, provide a revised estimate, and obtain your approval before continuing.

Consumer Rights Disclosure: You are entitled to a written estimate. Charges cannot exceed the estimate beyond the allowed tolerance without your approval. You have the right to receive replaced parts (with exceptions for warranty returns, cores, hazardous items, etc.). Contact the West Virginia Attorney General’s Consumer Protection Division for complaints.


3. Payment Terms and Mechanic’s Lien

  • Full payment is due upon completion and before vehicle release, unless other written arrangements are made.
  • We accept Cash, Checks, Debit/Credit Cards, Acima, Snap Finance, Sunbit, Klarna. Returned payments may incur fees.
  • Possessory Lien: Pursuant to West Virginia law, we have a possessory lien on the Vehicle for all authorized charges (labor, parts, storage, etc.). We may retain the Vehicle until paid and pursue remedies including sale after proper notice if unpaid.

Chargeback Protections: For credit/debit card payments, you agree not to initiate a chargeback for authorized charges except in cases of proven fraud. Any improper chargeback allows us to recover the amount, fees, collection costs, and attorney fees. You agree to resolve disputes directly with us first.


4. Warranties and Guarantees Our limited warranty applies only to the specific repairs/parts on the Work Order:

  • Duration: 1 year/12,000 miles, 2 years/24,000 miles, or 3 years/36,000 miles, whichever comes first, from repair completion (as noted per repair).
  • Covers defects in our workmanship and supplied parts under normal use and proper maintenance.
  • Claim process: Return the Vehicle to us with proof of repair for covered remedy (repair/replace at no charge for covered items).

Exclusions: Normal wear items (brakes, tires, etc., unless specified), misuse, abuse, neglect, accidents, modifications, lack of maintenance, pre-existing conditions, consequential damages (e.g., towing, rental, loss of use), and work by others. Warranty is generally non-transferable.


Disclaimer: Except as expressly stated, all work is "AS IS." We disclaim implied warranties of merchantability or fitness to the fullest extent permitted by WV law. This does not affect manufacturer warranties or your rights under WV lemon law or other consumer protections. 


5. Liability Limitations, Release, and Indemnification To the maximum extent permitted by West Virginia law:

  • Our total liability shall not exceed the amount you paid for the specific services at issue.
  • We are not liable for consequential, indirect, incidental, or punitive damages (e.g., loss of use, lost profits).
  • You release and hold harmless the Shop, its owners, employees, and agents from claims arising from the work, except those caused by our gross negligence or willful misconduct.
  • Test Drives: You authorize test drives/operation as needed.
  • Storage: Vehicles not picked up within 5 days of notification incur storage fees of $100/day. Unclaimed vehicles after proper notice may be treated as abandoned per law.
  • You indemnify us for claims arising from your breach, inaccurate information, or post-repair misuse. 


Parts Return: Per WV law, we will offer replaced parts to you upon request (exceptions for warranty/exchange, hazardous, or core returns). 


6. Customer Responsibilities

  • You confirm you are the owner or authorized agent.
  • Provide complete vehicle history.
  • Maintain the Vehicle per manufacturer guidelines (failure may void warranty).
  • Remove valuables; we are not liable for items left in the Vehicle.
  • Pick up promptly to avoid storage fees.


7. Invoices and Records Invoices will detail labor, parts (noting used/rebuilt if applicable), and totals. We retain records as required by WV law (at least 2 years for invoices). 


8. Dispute Resolution and Governing Law Disputes shall be governed by West Virginia law. Attempt good-faith resolution first. Unresolved matters may go to mediation, arbitration, or court in the appropriate WV county. Prevailing party may recover reasonable attorney fees where permitted. You may also file complaints with the WV Attorney General.


9. Miscellaneous 

Your Rights Under West Virginia Law We operate in full compliance with West Virginia consumer protection laws. You have the following important rights:

  • Written Estimate: You are entitled to receive a written estimate of the cost and completion date before any repair work begins.
  • Authorization: No repairs will be performed without your approval. You must authorize any additional work or changes.
  • Cost Limits: We cannot charge more than the estimate without your approval; except we may go up to the lesser of 20% of the estimate or $50 without further approval. If costs exceed this, we will contact you for approval of a revised estimate.
  • Replaced Parts: You have the right to receive the parts we remove from your vehicle (except for warranty returns, hazardous items, or cores).
  • Invoices: You will receive a detailed invoice showing labor, parts, and charges.
  • Complaints: If you have any concerns, you may contact the West Virginia Attorney General’s Consumer Protection Division.
  • Crash Parts: For body/collision repairs, you will receive disclosure if aftermarket parts are used.


Special Order Parts Policy Special Order Parts include, but are not limited to:

  • Any part not kept in our regular local inventory, (AutoZone, Napa, Advance Auto, O’Reilly AP)
  • Parts ordered from dealers, manufacturers, distributors, online/internet suppliers
  • Any part shipped from out of state
  • Custom, performance, or discontinued parts


Once you authorize the ordering of any Special Order Part(s), the order is non-cancellable and the part(s) are non-refundable and non-returnable for credit, except in the following limited cases:


  • The part is defective upon receipt and covered under the manufacturer’s warranty (we will assist with the warranty claim, but you remain responsible for any restocking or shipping fees charged by the supplier).
  • We receive written approval from the supplier for a return, which is extremely rare for special orders.


You acknowledge that special order parts are procured specifically for your vehicle at your request. You agree to pay for these parts in full at the time of ordering or upon delivery, whichever our policy requires at the time. We will make reasonable efforts to obtain the correct part based on the information you provide, but we are not responsible for delays caused by suppliers, manufacturers, shipping carriers, or backorders. All other standard return policies apply only to parts in our local inventories.
